Is your practice offering deals through Groupon or Living Social?  If so, you may be breaking the law and could face consequences.  Even Dan Ellis, the vice president of Align Technology (makers of Invisalign) does not endorse these deals for Invisalign.  Here are some highlights:

Ellis writes: “Because both your services and each Invisalign treatment are unique (like the needs of each patient), we do not believe that either are appropriate for the Web-based, group-buying social coupon process.”   Patients and doctors both should be protected by an exam that determines whether the patient is even a candidate for treatment.

Many complaints have been registered claiming: “the use of daily deal and group buying sites does not serve the best interest of the patient and is unethical and demeaning to the dental profession.

Also, when you use Groupon you have to share revenue with them.  This can be considered fee splitting.  Ellis also noted that in many states fee splitting is prohibited with third parties or non-practicioners.

So what’s the best advice?  Speak with your lawyer prior to any such offering or avoid the offerings alltogether.
